Terms & Conditions – Intimax

These Terms of Use (“Terms”) govern your access to and use of the website available at https://intimax.in/ (“Platform”), operated by Intimax India (“Company”, “we”, “us”, “our”). Through our Platform, we enable users (“you”, “your”) to purchase a range of personal wellness and lifestyle products (“Products”). We may also publish general information, blogs, articles, tips, FAQs, product usage guidance, and other educational content (“Information”) related to wellness, intimacy, and product care. By accessing, browsing or using the Platform, or by clicking “I AGREE”, “SUBMIT”, or similar prompts, you acknowledge that you have read, understood, and agree to be bound by these Terms and by all our policies incorporated herein, including our Privacy Policy, Shipping Policy, Returns & Cancellation Policy, and any other rules or notices published on the Platform (“Policies”).

If any Policy conflicts with these Terms, these Terms shall prevail. If you do not agree to these Terms, please discontinue using the Platform immediately. We may update, modify, or revise these Terms at any time, and your continued use of the Platform constitutes acceptance of the updated Terms.

2.1 Creating an Account

You may use the Platform either by creating an Intimax account (“Account”) or as a Guest.
An Account requires your email address and other details that may be authenticated via OTP.

Certain features (order tracking, saved addresses, offers, etc.) may not be available to Guest users.

2.2 Responsibility for Your Account

You are solely responsible for:

• Maintaining confidentiality of your login credentials
• All activities occurring through your Account
• Ensuring information provided is accurate and does not infringe third-party rights

2.3 Security Breach

If you suspect unauthorized access to your Account, you must contact our Grievance Officer immediately (details in Section 17).
We reserve the right to temporarily or permanently block or disable your Account if we detect any breach.

2.4 Termination

We may terminate, suspend, or restrict your Account or access to Products or services without notice in case of violations of these Terms or misuse of the Platform.

2.5 Updates

You must keep your device and browser updated and ensure compatibility with our Platform for proper functionality.

3. Limited License

3.1 We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for personal and non-commercial purposes.
3.2 You may not:

• Copy, download, reverse-engineer, modify, distribute, or reproduce Platform content
• Use any automated means to access the Platform
• Use the Platform or content for commercial purposes without written permission

We may terminate this license at any time without notice.

4. Product Description & Use

We reserve the right to correct inaccuracies at any time.

5. Payment

• UPI
• Wallets
• Any other modes available at checkout

5.2 Payments are processed via third-party payment gateways. We do not store your card or banking information and are not responsible for any third-party data practices.

5.3 Prices displayed include applicable GST and taxes unless stated otherwise.

6. Shipping & Delivery

Shipping timelines and delivery expectations are subject to our Shipping Policy published on the Platform.
Delivery delays may occur due to external factors beyond our control (logistics, weather, holidays, etc.).

7. Cancellation & Returns

Cancellations, returns, and replacements must adhere to our Returns & Cancellation Policy available on the Platform.

8. Refunds

Refund eligibility, timelines, and applicable conditions are detailed in our Returns & Cancellation Policy.

9. Third-Party Data & Advertising

9.1 Third-Party Services

We may use third-party tools and hosting services. While we select reputable providers, we are not liable for issues arising from third-party platforms.

9.2 Third-Party Advertising

The Platform may display advertisements or links to third-party websites.
We are not responsible for:

• Content on such sites
• Accuracy
• Privacy practices
• Any losses incurred through such links

You access third-party platforms at your sole risk.

10. Disclaimers

10.1 We may modify or discontinue Products at any time.
10.2 We are not liable for any direct or indirect losses arising from use of the Platform or Information.

You agree to indemnify and hold Intimax India harmless from any losses, liabilities, claims, or expenses arising from:

• Violation of these Terms
• Violation of applicable laws
• Misuse of your Account
• Third-party claims arising from your actions

14. Restrictions

You agree not to engage in activities such as:

• Posting harmful, illegal, misleading, defamatory, obscene, or hateful content
• Violating another person’s privacy or intellectual property
• Uploading viruses or harmful code
• Misrepresenting your identity
• Attempting unauthorized access
• Commercial misuse
• Harassing platform staff
• Posting misinformation or content prohibited by Indian law

Violation may result in account termination and legal action.

15. Term & Termination

These Terms remain effective until terminated by either party.
We may discontinue or modify the Platform at any time.
Upon termination, you must cease using the Platform and delete all stored content.

16. Electronic Communication

By using the Platform, you consent to receive emails, SMS updates, WhatsApp messages (if opted in), and notifications regarding orders, offers, or updates.

18. Survival

19. General Provisions

We may modify any part of the Platform or Products without notice. Continued use signifies acceptance.

19.2 Governing Law & Dispute Resolution

These Terms are governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of courts in [Insert City – e.g., Delhi or Mumbai].
Disputes will be resolved through fast-track arbitration, seat and venue in the same city.

19.3 Assignment

You may not assign rights or obligations.

19.4 Waiver
